These Terms & Conditions govern all purchases, deliveries, installations, website use, quotes, and communications made with Florida Sod Suppliers (“Company,” “we,” “us,” or “our”), operating through https://floridasodsuppliers.com.
By requesting a quote, placing an order, making a payment, scheduling delivery, or receiving sod or services from us, you agree to all terms below.

Live Agricultural Product – Important Disclosure
────────────
All sod sold by Florida Sod Suppliers is a live agricultural product. We guarantee only that all Floratam, Palmetto, and Bahia sod is fresh, healthy, and in good condition at the time it leaves the farm and at the moment of delivery or pickup.
Once sod is delivered or installed, results depend entirely on conditions outside of our control, including but not limited to:
• Soil quality and preparation
• Watering schedule and irrigation coverage
• Drainage and standing water
• Shade or lack of sunlight
• Foot traffic, pets, equipment
• Weather conditions (heat, drought, storms)
• Fungus, insects, weeds, and disease
• Fertilization or chemical treatments
Because of these uncontrollable factors, NO LONG-TERM SURVIVAL, PERFORMANCE, OR COLOR WARRANTY IS EXPRESSED OR IMPLIED.

2. NO REFUNDS – ALL SALES FINAL

Because sod is perishable, cut-to-order, and non-returnable, ALL SALES ARE FINAL.
• No refunds, returns, credits, or exchanges after delivery or pickup
• No refunds for sod loss caused by watering, soil, fungus, insects, neglect, heat, shade, or weather
• No refunds once sod has been installed
• No refunds for customer errors in quantity, grass type, or delivery location
By purchasing sod from us, you agree that you assume all risk of loss after delivery or pickup.

3. Minimum Orders
────────────
Florida orders require a 1-pallet minimum for both delivery and pickup. Larger quantities and full truckloads are available.

4. Orders, Quotes & Pricing
────────────
All quotes are estimates based on information provided by the customer. Final pricing is confirmed at payment.
Pricing may change based on:
• Grass type
• Quantity
• Farm availability
• Fuel and trucking costs
• Delivery location
Orders are not secured until payment has been received or approved.

5. Payments, Fees & Chargebacks
────────────
We accept approved payment methods including credit cards, Zelle, and other methods listed on your invoice.
If a credit-card processing fee applies, it will be disclosed.
By submitting payment, you agree:
• Not to file fraudulent disputes or chargebacks
• Not to reverse charges for delivered sod
• That all disputes must be addressed directly with Florida Sod Suppliers
Fraudulent chargebacks will be disputed with documentation and may result in collections or legal action.

6. Delivery Terms
────────────
Delivery dates and time windows are estimates, not guarantees.
Drivers will place sod as close as safely possible based on:
• Truck access
• Road conditions
• Property layout
• Safety regulations
We are not responsible for:
• Underground irrigation lines
• Invisible dog fences
• Septic systems
• Soft soil damage
• Cracked driveways or pavers
• Utility lines not properly marked

7. Installation Terms (If Provided)

If installation is provided directly or through partners:
• Soil conditions, drainage, and grading remain the owner’s responsibility
• Minor unevenness is normal and expected
• Settling, washouts, erosion, or puddling after installation are not covered
• Customer is fully responsible for immediate and daily watering

8. Customer Responsibilities – Watering & Care
────────────
Customer agrees to:
• Install sod immediately upon delivery
• Water thoroughly immediately after installation
• Water daily for 2–3 weeks (or more in extreme heat)
• Avoid mowing too short
• Delay weed treatments approx. 45 days
• Delay fertilizer approx. 90 days
Failure to follow proper care voids any claim of supplier responsibility.

9. Fungus, Insects & Disease
────────────
Florida’s climate naturally promotes fungus and insect activity. These are environmental conditions, not product defects.
Florida Sod Suppliers is not responsible for:
• Fungus outbreaks
• Chin bugs or other insects
• Disease spread
• Weed contamination after installation

10. Limitation of Liability
────────────
To the fullest extent permitted by Florida law, our total liability for any claim shall never exceed the amount paid for the sod on the specific order in question.
We are not liable for:
• Property damage
• Landscaping rework
• Lost profits
• Emotional distress
• Loss of enjoyment
• Consequential or indirect damages

11. Third-Party Installers
────────────
Any installer not directly employed by Florida Sod Suppliers is an independent contractor. We are not responsible for their workmanship, scheduling, pricing, or warranties.

12. Website & Communications
────────────
Information on our website is for general informational purposes. We do not guarantee errors will never occur.

13. Disputes & Governing Law

These Terms are governed by the laws of the State of Florida. Any dispute must be brought in a Florida court of proper jurisdiction.
